HILL, BARTH & KING LLC dba HBK CPA & Consultants (HBK) and its affiliated entities (“us,” “we” or “our”) created this Web Site Privacy Policy (“Privacy Policy”) to ensure the confidence of our visitors and clients (“you” or “your”) with our Web site (the “Site”), and to demonstrate our commitment to fair information practices and to protect your privacy.

1. Types of Information Collected.
a. Traffic Data Collected. We automatically track and collect the following information when you visit our Site or open one of our HTML emails, including your:  (i) domain server;  (ii) type of computer;  (iii) type of web browser; (iv) operating system; (v) referring service; (vi) web pages viewed; and (vii) usage & browsing habits (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful to improve your experience on the Site and to track site usage. We may also use “cookies” to customize content specific to your interests, to ensure that you do not see the same promotional content repeatedly.

b. Personal Information Collected. In order for you to access certain specialized services and/or to purchase products offered at the Site, we may require you to provide us with information that personally identifies you (“Personal Information”). Personal Information may include: (i) Contact Data (such as your name, mailing and e-mail addresses); (ii) Financial Data (such as your account or credit card number); (iii) Demographic Data (such as your zip code, age and income); and (iv) Location Data (such as IP address or geological data). If you communicate with us by Email, publicly accessible blog, social media platform or otherwise online, or complete survey forms online, any information you provide may be viewed and used by others as Personal Information without any restrictions.  Once such information is shared, the use of your information will be subject to that service’s privacy policy and this Privacy Policy will not apply.

c. Job Search. Through our Site we provide access to employment listings under the title “Current Openings.” When you submit a resume through Current Openings, we will treat your resume with the same degree of confidentiality as if you had submitted it to us via regular mail. 2. Uses of Information Collected.
We may share Contact Data or Demographic Data with our Email Marketing Provider or use it to email you information about HBK or our products or services, or promotional material, or to contact you when necessary. We may use your Financial Data to verify your qualifications for certain products or services and to bill you for products and services. We may share Location Data with our Analytics and Conversion Tracking Provider.  We may use your Demographic Data to customize and tailor your experience on the Site, displaying content that may interest you according to your preferences.

3. User Choice Regarding Collection, Use and Distribution of Personal Information.
If you do not wish to receive information and promotional material from us or from some of our partners, you may select the appropriate “opt out” option each time we ask you for Personal Information.

4. Confidentiality and Security of Personal Information.
We will not sell your Personal Information to a Third Party.  Except as otherwise provided in this Privacy Policy we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; or (b) protect our rights or property. Your Personal Information is stored on secure servers that are not accessible by third parties. We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser. We will obtain your permission to release your Personal Information before allowing you to use any of our services that require us to release your Personal Information to a third party.

5. Lost or Stolen Information.
For those who are registered to use the site for specialized services or to purchase products, you must promptly notify us if your credit card, user name or password is lost, stolen or used without permission. In such an event, we will cancel that user name or password and update our records accordingly.  HBK does not store or retain credit card information.

6. Protection for Children.
We do not collect personally identifiable information from children under the age of 13. If at any time in the future we plan to collect personally identifiable information from children under 13, such collection and use, to the extent applicable, shall, when required, be done in compliance with the Children’s Online Privacy Protection Act (“COPPA”) and appropriate consent from the child’s parent or guardian will be sought where required by COPPA. When we become aware that personally identifiable information from a child under 13 has been collected without such child’s parent or guardian’s consent, we will use all reasonable efforts to delete such information from our database.

7. Other Limits to Your Privacy.
The Site contains links to other Web sites. We are not responsible for the privacy practices or the content of such Web sites. Please understand that any information that is disclosed in these areas becomes subject to the privacy policies and practices of those sites. We have no control over its use and you should exercise caution when deciding to disclose your Personal Information.

8. California Consumer Privacy Act (CCPA) Requests:
In order to access your rights under the CCPA to access data, and or request deletion, described in this policy, you must fill out the Personal Data Request Form or call HBK at 1-800-733-8613.

Only you, the consumer, or a person registered with the secretary of state authorized to act on your behalf, may make a verifiable CCPA request related to your personal information. You may also make a request on behalf of your minor child.

The verifiable consumer request must:

  • Provide sufficient information that allows HBK to reasonably verify you are the person about whom we have collected personal information or an authorized representative thereof.
  • Describe your request with sufficient detail that allows HBK to properly understand, evaluate, and respond to your request.

HBK is unable to respond to your request or provide you with personal information, if it cannot verify your identity or authority to make the request, and confirm the personal information relates to you.

You may only make such a request twice within a twelve (12) month period.

The information you provide in order to make the request will only be used to verify your identity or authority to make the request.

9. Updates and Changes to Privacy Policy.
We reserve the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on the Site. Any such change, update or modification will be effective immediately upon posting on the Site.

By accessing or using the HBK site, you acknowledge that you fully understand and accept HBK’s privacy policy and all of the terms, conditions and limitations of the site.
